Terms of Use and Licence Agreement

These Terms of Use and Licence Agreement govern access to and use of the CaseFolio website and desktop application.

By accessing the website, downloading the software, installing CaseFolio, or using CaseFolio, you agree to these terms.

About CaseFolio

CaseFolio is a desktop document and bundle management tool designed to assist professional document workflows through local desktop processing and automated bundle generation.

CaseFolio is intended as an administrative and productivity tool only. It is not a substitute for professional judgment, procedural compliance, independent review, legal advice, procedural advice, regulatory guidance, quality control, or user verification.

Licence

CaseFolio is licensed, not sold.

Subject to these terms, users are granted a limited, non exclusive, non transferable, revocable licence to use the software for lawful professional or personal purposes.

Use of CaseFolio is discretionary. Permission to access, download, install, or use CaseFolio may be withdrawn, restricted, suspended, or revoked at any time where reasonably necessary, including for security, operational, maintenance, misuse, legal, licensing, compliance, or other legitimate reasons.

User Responsibility

Users remain solely responsible for independently reviewing, validating, and verifying all generated documents, bundles, pagination, hyperlinks, references, indexes, bookmarks, formatting, exported outputs, filing requirements, service requirements, disclosure requirements, and procedural compliance before filing, service, disclosure, distribution, reliance, professional use, or court use.

Users must independently verify the accuracy, completeness, suitability, and reliability of all outputs generated by the software. CaseFolio does not guarantee that any bundle, index, pagination, hyperlink, bookmark, export, format, or output will be accepted by any court, tribunal, regulator, organisation, opponent, client, or third party.

Local Processing and Privacy

Documents processed by the desktop application remain on the user’s local device unless the user chooses to export, upload, transmit, print, share, sync, back up, or distribute them externally.

Users are responsible for maintaining appropriate backups, cybersecurity protections, antivirus software, system updates, access controls, storage safeguards, and IT protections.

No Legal, Procedural, or Professional Advice

CaseFolio provides software tools only. It does not provide legal advice, procedural advice, regulatory guidance, filing advice, disclosure advice, professional advice, or any recommendation as to how a document or bundle should be prepared, filed, served, disclosed, relied upon, or used.

Acceptable Use

Availability, Support, and Updates

CaseFolio may be modified, suspended, updated, restricted, withdrawn, or discontinued at any time without notice.

Support, updates, maintenance, bug fixes, future compatibility, continued availability, and compatibility with any operating system, device, printer, PDF reader, cloud service, third party software, storage environment, or hardware configuration are not guaranteed.

No Warranty

While reasonable efforts are made to maintain the reliability and functionality of the software, CaseFolio is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, no warranties or guarantees are given, whether express or implied, including regarding accuracy, completeness, compatibility, uninterrupted operation, availability, error free operation, security, merchantability, fitness for a particular purpose, procedural compliance, or suitability for any jurisdiction, court, tribunal, organisation, professional obligation, or workflow.

Limitation of Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Subject to the above, and to the maximum extent permitted by applicable law, CaseFolio and its developers shall not be liable for any:

This includes losses arising from or connected with the use of the software, generated outputs, exported documents, bundle structures, pagination, hyperlinks, indexes, bookmarks, formatting, installation, updates, technical operation, compatibility issues, system interactions, device instability, software conflicts, storage failures, or IT related issues.

Subject to the exclusions above, the total aggregate liability of CaseFolio and its developers arising out of or in connection with the software, website, licence, or these terms shall be limited to the greater of: (a) £50; or (b) the amount paid by the user for CaseFolio in the 12 months before the event giving rise to the claim.

Third Party Software and Open Source Components

CaseFolio may include or interact with third party software, libraries, packages, frameworks, or open source components. Those components may be subject to separate licence terms, notices, attribution requirements, or restrictions.

Users must not remove, obscure, or interfere with any third party notices, licence notices, copyright notices, or attribution materials supplied with the software.

Intellectual Property

CaseFolio, including the software, branding, interface, design, website content, documentation, graphics, and associated materials, is protected by intellectual property rights and remains the property of its respective owners unless otherwise stated.

Independent Product

CaseFolio is an independent software product and is not affiliated with, endorsed by, or associated with any law firm, court, tribunal, government body, regulator, or third party organisation unless expressly stated.

Changes

These terms may be updated periodically without notice. Continued access to or use of CaseFolio after changes are published indicates acceptance of the updated terms.

Governing Law

These terms are governed by the laws of England and Wales.

Any dispute arising in connection with these terms or the software shall be subject to the exclusive jurisdiction of the courts of England and Wales.
